Defendant in a Divorce Action

You have been served with a Statement of Claim for Divorce (or a Statement of Claim for Divorce and Division of Matrimonial Property) which was filed in the Court of Queen’s Bench of Alberta.

Time Limits
Unless the Plaintiff or their lawyer agrees to give you extra time, you must take the steps listed here within the following time periods:

  • If you were served in Alberta, within 20 days of the day you were served;
  • If you were served elsewhere in Canada, within 1 month of the day you were served;
  • If you were served outside of Canada, within 2 months of the day you were served.

What can be contested
The grounds are listed in paragraph 3 of the Statement of Claim.  If you believe they are not true, you can contest them.
The Remedies Sought are listed towards the end of the Statement of Claim.   If you disagree with any of these, you can contest them.
